When Congress was in the process of passing the Pension Reform Act of 2006, there was an effort to include an unqualified right of reimbursement in favor of ERISA insurers. The House of Representatives included such a provision in its version. Many, including myself, lobbied the Senate/House conference committee for the purpose of defeating this provision. Eventually the measure was removed.
